Terms of Service

These Terms of Service ("Terms") govern your access to and use of the saverelease platform ("Platform", "Service"), operated by saverelease ("we", "us", "our"), accessible at saverelease.com. By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, do not use the Platform.

1. Definitions

  • "User": means any individual or entity that accesses or uses the Platform.
  • "Content": means any text, images, audio, links, metadata, or other materials uploaded or submitted by Users.
  • "Smartlink": means a generated page aggregating links to a release across multiple platforms.
  • "Credits": means the virtual currency used within the Platform to access premium features.

2. Eligibility

You must be at least 13 years old to use the Platform. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We reserve the right to request proof of age at any time and to terminate accounts that violate this requirement.

3. Account Registration

  • You must provide accurate, complete, and current information during registration.
  • You are solely responsible for maintaining the confidentiality of your credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorized use of your account.
  • We reserve the right to suspend or terminate accounts at our sole discretion, with or without notice.

4. Acceptable Use

You agree NOT to:

  • Upload, share, or link to content that infringes on any third party's intellectual property rights, including but not limited to copyrights, trademarks, and patents.
  • Use the Platform for any illegal, fraudulent, or harmful purpose.
  • Distribute malware, spam, phishing links, or other malicious content.
  • Attempt to gain unauthorized access to the Platform, other users' accounts, or our systems.
  • Use automated tools, bots, scrapers, or crawlers to access the Platform without our prior written consent.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Interfere with or disrupt the integrity or performance of the Platform.
  • Circumvent, disable, or otherwise interfere with security-related features of the Platform.

5. User Content

5.1 Ownership

You retain all ownership rights to your Content. By uploading Content to the Platform, you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, modify, display, and distribute your Content solely for the purpose of operating and providing the Platform.

5.2 Responsibility

You are solely responsible for the Content you upload. You represent and warrant that you have all necessary rights, licenses, and permissions to upload and share such Content, and that your Content does not violate any applicable law, regulation, or third-party right.

5.3 Removal

We reserve the right to remove or disable access to any Content that we determine, in our sole discretion, violates these Terms, any applicable law, or the rights of any third party, without prior notice.

6. Intellectual Property

The Platform, including its design, code, branding, logos, and all associated intellectual property, is owned by saverelease and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Platform without our prior written consent.

7. Copyright / DMCA Policy

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA) and equivalent international copyright laws. If you believe that Content on the Platform infringes your copyright, you may submit a takedown notice to:

Your notice must include:

  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the infringing material and its location on the Platform.
  • Your contact information (name, address, phone number, email).
  • A statement that you have a good faith belief that the use is not authorized.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.
  • Your physical or electronic signature.

We will respond to valid takedown notices promptly. Repeat infringers will have their accounts terminated.

8. Credits and Payments

  • Credits are a virtual currency used on the Platform and have no cash value outside the Platform.
  • All credit purchases are final and non-refundable, except as required by applicable law.
  • We reserve the right to modify credit pricing, features, and availability at any time.
  • Unused credits do not expire unless the account is terminated for violation of these Terms.
  • For refund requests, contact us at support@saverelease.com within 14 days of purchase if the service was not delivered as described.

9. Third-Party Services

The Platform may contain links to or integrations with third-party services (e.g., Spotify, Apple Music, YouTube). We are not responsible for the availability, content, privacy practices, or policies of any third-party services. Your use of such services is subject to their respective terms and policies.

10. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SAVERELEASE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to, use of, or inability to access or use the Platform;
  • Any conduct or Content of any third party on the Platform;
  • Any Content obtained from the Platform;
  • Unauthorized access, use, or alteration of your transmissions or Content.

OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

12. Indemnification

You agree to indemnify, defend, and hold harmless saverelease and its officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property, privacy, or publicity rights; or (d) any Content you upload or share on the Platform.

13. Termination

  • We may suspend or terminate your account at any time, for any reason, with or without notice.
  • You may delete your account at any time through the Platform settings.
  • Upon termination, your right to use the Platform ceases immediately.
  • Sections that by their nature should survive termination (including but not limited to Sections 5, 6, 10, 11, 12, 14, and 15) shall survive termination.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of laws provisions. For users within Turkey, the Consumer Arbitration Committees and Consumer Courts of Istanbul shall have jurisdiction. For international users, any dispute arising from these Terms shall be resolved through binding arbitration under the rules of the Istanbul Arbitration Centre (ISTAC), and the place of arbitration shall be Istanbul, Turkey.

15. General Provisions

  • Entire Agreement: These Terms constitute the entire agreement between you and saverelease regarding the Platform.
  • Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
  • Waiver: Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.
  • Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights without restriction.
  • Modifications: We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform. Continued use after changes constitutes acceptance.
