Distance Sales Agreement

This Distance Sales Agreement ("Agreement") is entered into between saverelease ("Seller", "we", "us") and the user purchasing credits or premium services through the Platform ("Buyer", "you"). This Agreement is governed by Turkish Consumer Protection Law No. 6502, the Distance Contracts Regulation, and applicable international consumer protection laws.

1. Parties

1.2 Buyer

The individual or entity who has registered an account on the Platform and initiates a purchase. Buyer information is as provided during account registration and at the time of purchase.

2. Subject Matter

This Agreement governs the sale of digital products and services through the Platform, including but not limited to:

Credits: Virtual currency units used to access premium features on the Platform.
Premium Features: Enhanced smartlink customization, analytics, priority support, and other features accessible through credits.

The Buyer acknowledges that all products sold through the Platform are digital in nature and are delivered electronically upon completion of payment.

3. Product/Service Specifications

The features, scope, and pricing of products/services are as described on the Platform at the time of purchase.
Prices are displayed in the currency specified on the Platform and include applicable taxes unless stated otherwise.
We reserve the right to modify pricing at any time; however, changes will not affect completed transactions.
All product descriptions, features, and specifications are available on the relevant purchase page prior to transaction.

4. Order and Payment Process

The Buyer selects the desired product/service and proceeds to checkout.
The Buyer reviews the order summary, including price, quantity, and description.
The Buyer confirms the order and proceeds to payment.
Payment is processed through secure third-party payment providers.
Upon successful payment, an order confirmation is sent to the Buyer's registered email address.
Digital products are delivered (credits are added to the account) immediately upon payment confirmation.

5. Price and Payment

All prices are listed on the Platform in the applicable currency.
Prices include all applicable taxes (including VAT/KDV where applicable).
Payment methods accepted include credit/debit cards and other methods as displayed during checkout.
We do not store your full payment card information. All payment processing is handled by PCI-DSS compliant third-party processors.
The total amount charged will match the amount displayed at the time of order confirmation.

6. Delivery

All products sold through the Platform are digital and delivered electronically.
Credits and premium features are activated instantly upon successful payment.
Delivery is deemed complete when the digital product is made available in the Buyer's account.
If delivery fails due to a technical error, the Buyer should contact support@saverelease.com, and we will resolve the issue within 3 business days.

7. Right of Withdrawal

7.1 General Right

Pursuant to Turkish Consumer Protection Law No. 6502, Article 48, and the Distance Contracts Regulation, Article 9, the Buyer has the right to withdraw from the contract within 14 (fourteen) days from the date of purchase without providing any reason.

7.2 Exceptions to the Right of Withdrawal

In accordance with Article 15 of the Distance Contracts Regulation and EU Directive 2011/83/EU, the right of withdrawal does not apply in the following cases:

Digital content that has been delivered and the performance has begun with the Buyer's prior express consent and acknowledgment that the right of withdrawal will be lost.
Services that have been fully performed with the Buyer's prior express consent.
Credits that have already been used or partially consumed.

7.3 How to Exercise the Right of Withdrawal

To exercise your right of withdrawal:

Send a clear statement to support@saverelease.com within 14 days of purchase.
Include your account email, order/transaction ID, and date of purchase.
You may use the following template: "I hereby declare that I withdraw from my contract for the purchase of [product/service], ordered on [date], order ID [ID]."

7.4 Refund Process

Upon valid withdrawal, we will refund the full amount within 14 days of receiving your withdrawal notice.
The refund will be made using the same payment method used for the original transaction.
If credits have been partially used, only the unused portion will be refunded.

8. Warranty and Liability

We warrant that digital products will function as described at the time of purchase.
If a purchased feature does not work as described, the Buyer may request a fix, replacement, or refund.
Our total liability for any claim arising from a purchase shall not exceed the amount paid for that specific transaction.
We are not liable for issues arising from the Buyer's own equipment, internet connection, or third-party services.

9. Force Majeure

Neither party shall be liable for delays or failures in performance resulting from causes beyond their reasonable control, including but not limited to natural disasters, wars, terrorism, riots, pandemics, government actions, internet infrastructure failures, power outages, or cyberattacks.

10. Dispute Resolution

10.1 For Buyers in Turkey

In accordance with the Consumer Protection Law No. 6502 and the Consumer Arbitration Committees Regulation:

For disputes up to the monetary threshold set by the Ministry of Commerce, the Consumer Arbitration Committee in the Buyer's province of residence shall have jurisdiction.
For disputes above this threshold, the Consumer Courts shall have jurisdiction.
The Buyer may also apply to the online dispute resolution platform provided by the Ministry of Commerce.

10.2 For International Buyers

We encourage resolution through direct communication first via support@saverelease.com.
If a dispute cannot be resolved amicably, it shall be resolved through binding arbitration under the rules of the Istanbul Arbitration Centre (ISTAC).
EU consumers may also use the European Commission's Online Dispute Resolution (ODR) platform.

11. Data Protection

Personal data collected during the purchase process is processed in accordance with our Privacy Policy. Payment data is processed by PCI-DSS compliant third-party providers. We do not access or store your full payment card details.

12. Amendments

We may update this Agreement from time to time. Changes will be posted on this page with an updated date. Material changes will be communicated via email. The version in effect at the time of your purchase governs that transaction.

13. Severability

If any provision of this Agreement is found to be invalid or unenforceable by a competent court or arbitration body, the remaining provisions shall continue in full force and effect.

14. Governing Law

This Agreement is governed by and construed in accordance with the laws of the Republic of Turkey, including but not limited to the Consumer Protection Law No. 6502, the Turkish Code of Obligations No. 6098, and the Electronic Commerce Law No. 6563. For international buyers, mandatory consumer protection laws of the buyer's country of residence shall also apply to the extent they provide a higher level of protection.

15. Buyer's Acknowledgment

By completing a purchase on the Platform, the Buyer acknowledges that:

They have read and understood this Agreement in its entirety.
They have been informed of the product/service specifications, price, payment method, and delivery conditions before completing the purchase.
They are aware of their right of withdrawal and its exceptions as described in Section 7.
They consent to the immediate delivery of digital content and acknowledge that this may affect their right of withdrawal.
